Need legal advice..where to go? - Lightning Forum

I need some information as to what options I have as far as small claims court or other legal means to get back money from a vendor on here for a product that was never received or even ordered on my behalf. I'm not sure of the steps I need to take in dealing with an online transaction of this type, this is a first for me. It looks like I'd need to file in their state, does that mean I would have to travel there to present my case? I'm pretty upset that the situation has come to this, but after repeated pm's, e-mails and a phone calls I don't have any other options. Even after righting situations with other people I feel like I've been pretty much ignored. Please just advice only, I don't want any verbal bashing or "kick his ass seabass!" comments.

Maybe contacting the attorny generals office in that particular state to see what they suggest?

how much money are you out?

I would suggest filing a complaint with your credit card before you waste your time and money with small claims

$1500. It was thru paypal, but since I was told 4-6 weeks and found out that the order had never been placed or paid for at 10 weeks. I'm way past paypals 45 days so I was going to file a dispute with my credit union since my paypal pulls str8 from my account. I finally got 1 reply to a PM and was told he would check on the order over this last weekend. Well now I am past the 60 days I have to file with my CC because I was trying to give him the benefit of the doubt and I have yet to hear anything. I've e-mailed ever e-mail address I can find and called today, still nothing. I'm done playing games. I'm just trying to be civil right now.

I would still attempt filing w/ ur credit card company u should have fraud protection and essentially thats what it's upto now especially since said person strung u along after the 60 days.

Yup, I would still call your credit union and get them on it.

What was said after the PM last week? Not down playing the situation, but with this being a holiday weekend...

No I haven't contacted Rob, I will shoot him a PM tho. The funds came straight from my bank account, I'm going to file anyways but since it's past 60 days I'm basically being told by a family friend that still works there that they won't do anything. I sent him the PM on the 19th, got no reply and then saw he posted a thread. After I posted in the thread he sent me a PM on the 21st saying he'd get ahold of the vendor that weekend. Here we are on the 28th and still no reply. I just called again and still no answer...

I had my Bank acct charged for stuff i never ordered,the order was placed out side of the US. So went to my CU and they gave me my money back the same day and went after the scamer them selfs. I hope this helps and yes calling the AG in that stae and your might help a little,not with geting your money back but geting them caught in a leagal web LOL. I always check a dealer out on BBB before i buy a high priced iteam!!!

bro u have upto 6 mths to do a stop payment, I know the money has already been withdrawn I may have to check the regulations but i'm pretty sure u have can file a fraud claim at anytime especially with your particular situation on the place u are at!

U will have to sign documentation that u are going to prosecute to the full extent the bank is willing to take it though!

does that apply if I received part of the order? I ordered 3 things and received 2, but they were only $110. I'm going to the CC as soon as I get home, it's too difficult trying to do anything from over here.
